Terms of Service

These Terms of Service (“Terms”) govern the services provided by Phoenix Basin Landscaping & Irrigation, LLC (“we,” “us,” or “our”) to you, the client (“you” or “client”). By requesting, accepting, or paying for services, you agree to the following:
1. Scope of Work
All services to be performed will be described in the provided estimate, proposal, or service agreement. Additional work not included in the original scope may require a revised quote or written approval.
2. Access to Property
You agree to provide safe and reasonable access to the property during the scheduled service window. This includes:
- Unlocked gates
- Secured pets
- Unobstructed access to work areas
- Access to irrigation controls, outdoor water, or electrical outlets if required
If we are unable to access the property due to safety or accessibility issues, it may be treated as a no-show, subject to a $75 fee (see Refund & Cancellation Policy).
3. Payment Terms
Payment is due in full before or at the time of service, unless otherwise agreed in writing. We reserve the right to delay or cancel service if payment is not received.
Accepted payment methods may include:
- Credit/debit cards
- Bank transfers
- Checks
- Digital payment platforms (if applicable)
Any returned checks or disputed charges may incur additional fees.
4. Rescheduling, Refunds & Cancellations
Please refer to our Refund & Cancellation Policy, which is incorporated into these Terms by reference. Key highlights:
- No refunds after service is completed
- Cancellations within 48 hours are not eligible for refund
- Rescheduling within 24 hours may be subject to a $75 fee
- Medical emergencies and force majeure events are handled case-by-case
5. Service Limitations & Disclaimers
We are not responsible for:
- Pre-existing damage to landscaping, hardscaping, irrigation systems, or structures
- Damage to unmarked underground lines, utilities, or obstructions
- Plant loss due to weather, watering habits, or natural conditions beyond our control
Any warranties (if offered) will be described separately in writing. Warranty services are non-refundable.
6. Weather & Scheduling Delays
Outdoor services are weather-dependent. We reserve the right to reschedule services due to:
- Rain or flooding
- Excessive heat

Unsafe working conditions
You will be notified as early as possible, and no fees will be charged for reschedules caused by weather or other force majeure events.
7. Photography & Documentation
We may take before-and-after photos of your property for quality control, insurance, or dispute resolution purposes.
Photos will not be used for marketing unless we receive your written consent.
Clients who opt in may be eligible for future service discounts.
8. Liability Limitations
To the extent permitted by law, Phoenix Basin Landscaping & Irrigation, LLC is not liable for:
- Indirect, incidental, or consequential damages
- Client negligence, misuse, or failure to follow care instructions
- Delays caused by third parties, supply shortages, or events outside our control
9. Dispute Resolution
In the event of a disagreement, both parties agree to attempt informal resolution first. If unresolved, disputes shall be submitted to binding arbitration in the county of Maricopa, AZ, rather than through litigation.
10. Policy Updates
We may update these Terms periodically. The most current version will be posted on our website and apply to all future services.
